Introduction:
second-jobber.com (“the Site”) is a website which is owned, designed and operated by graduate-jobs.com Limited (“the Company”). The term “You” or “Your” is used to refer to all persons accessing the Site for any reason.

These are the terms and conditions (“the Terms”) which govern your use of the Site. Please read them carefully. Our rate card and Privacy Policy which also appear on the Site, form part of the Terms. Please also see our anti-ageism guide.

By accessing the Site and/or by registering, you agree to be bound by the Terms and to follow them at all times. The Company may revise the Terms at any time. You should review this page regularly as the revised Terms will be binding upon you.

The purpose of the Site is to establish contact between potential employer's ("Client(s)") or recruitment agencies ("Agent(s)") and jobseekers ("Candidate(s)"). Clients can, by first registering, post job vacancy details on to the Site, which Candidates, following registration, can browse and respond to, directly to the Client or Agent.

In addition, Candidates can upload their own personal details, in the form of a virtual curriculum vitae, which can be viewed by Clients or Agents. Candidate details can be removed by the Candidate at any time. There is no charge to Candidates for any service offered on the Site by the Company.

The Company offers a variety of services at a fee, to Clients and Agents including job posting facilities, logo and banner advertising, construction of mini sites, corporate web pages or links thereto, search keyword sponsorship, direct email of job details to Candidates, email promotional services etc. These services are offered on the terms and for the fees set out in our rate card.

The Company authorises you to view and download material from the Site solely for your personal, non-commercial use.

The content of the Site is the property of the Company or its content suppliers or of its Clients. The compilation of the Site, meaning the collection, arrangements and assembly of all content on the Site is the exclusive property of the Company and protected by copyright laws. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from this site, except as set out in these Terms.

Registration and Site Use:
The Site may only be used for lawful purposes by Candidates seeking employment and Clients and Agents seeking Candidates.

The details provided by you on registration are important and must be complete, truthful, accurate and reliable. You are responsible for your own communications and postings on or via the Site. You must update your details on the Site immediately, in the event that the posted details change.

You will be issued with a user name and password. These are personal to you and you agree that you will not disclose them to anyone else. You are responsible for use of your user name and password by any third party.

You will not do anything that would assist a non-registered user to gain access to any part of this site.

If we wish to terminate your access to the Site, we will do so by emailing you at the address you have registered. You can unsubscribe by emailing the site supervisor at unsubscribe@second-jobber.com. Your user name and password will become invalid immediately.

Set out below is a non-exhaustive list of prohibited uses of the Site. In the event that you engage in prohibited uses of the Site, the Company may terminate your access to the Site immediately, without liability and without notice to you. Prohibited uses of the Site include:

  1. use in violation of any applicable law or regulation.
  2. uploading or introducing unlawful material or material which in our opinion, is pornographic, obscene, offensive, abusive, defamatory, discriminatory (on grounds of race, sex, religion or religious belief, disability, sexual orientation, age, marital status, civil partnership status or otherwise), malicious or threatening.
  3. uploading or introducing false or fraudulent job or Candidate details.
  4. deleting or revising any material posted by another person.
  5. posting material that is copyrighted unless you are the copyright owner or have the permission of the copyright owner to post it; or posting material that infringes on the intellectual property rights of others or on the privacy of others.
  6. posting links or references to other web sites within any job advert posted to the web site second-jobber.com
  7. inclusion of client or third party company e-mail addresses within any job advert posted to the Site.
  8. use by any company, individual, partnership or body whom the Company believe to be in the same field of endeavour, either directly or indirectly.

We reserve our rights to and you consent to our monitoring of the Site to ensure that it is being used lawfully and in accordance with these Terms.

Warnings:
The Company does not represent or guarantee the truthfulness, accuracy or reliability of communications posted by users or endorse any opinions expressed by users. You acknowledge that any reliance on material posted by other users will be at your own risk.

The Company does not verify or check, in any manner, the Client, Agent, Candidate or job vacancy details posted on this site. The Company advises that Candidates should make independent checks on job vacancies advertised on this site before responding to them. The Company advises that Clients or Agents independently verify the credentials and qualifications of Candidates responding to any vacancy advertisements. The Company does not accept any liability in respect of vacancies or Candidate credentials provided through the Site.

We reserve the right to forward details to the Police, Regulatory Authorities, (including the Department of Trade and Industry, Employment Agencies Standards Directorate and the Information Commissioner), legislative and judicial bodies, should your use of the Site breach any applicable law or regulations or be inconsistent with these Terms.

For the avoidance of doubt, the Site is a bulletin board or venue and is not an employment business or an employment agency within the meaning of the Employment Agencies Act 1973 or any regulations made pursuant thereto. The Company acts as a passive conduit for the online distribution and publication of user submitted information only.

Intellectual Property Rights:
By submitting content to the Site, you grant the Company a royalty free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate and display the content (in whole or in part) and to incorporate it in other works in any form, media or technology now known or later developed for the full term of any rights may exist in such content, or until such time as you shall prescribe in writing.

The Company is the owner and/or authorised users of any trademarks, registered trademarks and/or service marks used or appearing within the Site, and are the copyrights and database rights owners of the content and/or information available on or downloaded through the Site.

The Company does not grant any license or other authorisation to any user of its trademarks, registered trademarks, service marks, or other copyright works or other intellectual property, by placing them on the Site.

Liability:
The Site is provided on a "as is" and "as available" basis without warranty, condition or commitment of any kind, whether express or implied. The Company makes no representation, warranty, commitment in relation to the provision of the Site including those as to the availability, the quality or fitness for purpose of the Site, or the completeness, accuracy and up-to-datedness of any information, data, services, or products provided through or in connection with the Site.

We make no warranty that the contents of this site are free from infection by viruses or anything else which has contaminating or destructive properties and shall have no liability in respect thereof.

This site contains links that lead to other sites over which we have no control and accordingly we accept no responsibility or liability for any of the material contained on those sites.

To the maximum extent permitted by applicable law the Company disclaims and excludes all liability (whether arising in contract, tort (including negligence), breach or statutory duty or otherwise) arising from any inaccuracy, failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorised access to, alteration of, or use of any record. Under no circumstances shall the Company be liable to you for any loss or damage suffered (both direct and indirect losses) arising from your use of the Site.

Nothing in these Terms shall operate to limit liability for death or personal injury caused by the Company’s negligence, fraudulent misrepresentation made by the Company or any other statutory rights which are not capable of being excluded.

The Company shall not be liable for any failure to perform any obligation caused by any event beyond its reasonable control.

Law
These conditions are governed by English law and the Client and the Candidate hereby submit to the exclusive jurisdiction of the English Courts

PRIVACY POLICY
This policy sets out the approach taken by [graduate-jobs.com Ltd ("the Company" "We", "Us", "Our") to the personal information of users of second-jobber.com (“the Site”). By accessing and posting information on the Site, you agree to the terms set out in this policy. Privacy and confidentiality are at the heart of our service. The Company will only record your personal data as set out in this policy. We will not give, rent, sell or trade any of your identifiable personal information.

What information do we collect and why?

The Company may need to take personal data from you (including your name and email) where this is necessary to communicate with you. You will have a choice whether to give this information to us or not. We will use this information to communicate with you in accordance with the policy. We will not use or disclose your personal information given to us for communication with you for any other purpose.

The Site offers more than a recruitment service. We may provide information, offers and services that may be of interest to you. The Site will also provide access to a range of third party suppliers and other information Sites. The more we know about you, the more value we can offer you by way of a personalised Site. We may store certain information and use this to offer you personalised services, information and offers through the Site. At no point will this information be disclosed to any third party whatsoever. We will always disclose to you the type of information we collect.
